Police ordered to arrest Akinyi over property row - She was recently released from an Indian court after being arrested with her boyfriend for failing to declarer foreign currency

Kenya police were on Friday ordered to arrest a woman battling for the control of property with her estranged husband after she failed to appear in court for the hearing of a case in which she is accused of causing a public disturbance.
Kibera resident magistrate Margaret Kasera issued an arrest warrant against Ms Joyce Akinyi following an application by the prosecutor, Inspector Gabriel Nyongesa.
Neither Ms Akinyi nor her lawyer was in court when the hearing started, prompting Ms Nyongesa to issue the warrant of arrest.Ms Akinyi also failed to appear for the previous hearing on May 12, and her lawyer then told the court that she had been summoned to appear in an Indian court.
Apart from causing public disturbance, the charge further states that Ms Akinyi threw beer bottles at her husband Anthony Chinedu, thereby threatening to cause a breach of the peace. The offence was allegedly committed at Deepwest Resort, Nairobi, on March 30, this year.
Evidence
The defence then asked for adjournment, but Inspector Nyongesa objected to the application and applied for an arrest warrant against Ms Akinyi.
He argued then that the defence had not produced any documentary evidence to support its allegations that Ms Akinyi was out of the country.
The magistrate ruled that the accused should produce travel documents and a copy of the summons to show that she travelled to India. Ms Nyongesa on Friday fixed the mention on June 5.
